PRE-INFORMATION FORM
1. SUBJECT
1.1 The subject of this Pre-Information Form is to inform the BUYER about the rights and obligations of the parties regarding the sale and delivery of the product/products specified below, in accordance with the provisions of the Law No. 6502 on the Protection of Consumers - Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188). By accepting this Pre-Information Form, the BUYER acknowledges that if they confirm the service request subject to the contract, they will be obligated to pay the service fee and any additional charges such as taxes, and that they have been informed about this in advance.

4. INFORMATION ABOUT THE PRODUCT/PRODUCTS SUBJECT TO THE CONTRACT
4.1 The main features of the goods/product/products/service (type, quantity, brand/model, color, number) are available on the SELLER’s website.
4.2 The quantity, price, and payment (collection) information of the goods or services purchased by the Customer are specified below: The announced prices or promises are valid until they are updated and changed. Prices announced for a specific period are valid until the end of the specified period.
4.3 To avoid any doubt; in cases where the BUYER pays the sales price with a credit card, installment card, etc., provided by banks (including financial institutions), all facilities provided by these cards are directly provided by the card-issuing institution; therefore, sales realized where the SELLER collects the price in one go or in installments are not credit or installment sales for the parties to this Agreement, but are cash sales. The SELLER’s legal rights in cases legally considered installment sales are reserved under the relevant legislation.
4.4 The shipping cost of the product, any other taxes, duties, and fees will be paid by the BUYER.

6. RIGHT OF WITHDRAWAL
6.1 The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the product to the BUYER or the person/organization at the address indicated, without giving any reason, in sales contracts for goods. In distance contracts for the provision of services, this period starts from the date the contract is signed. The BUYER must notify the SELLER of the use of the right of withdrawal within this period. The BUYER acknowledges in advance that they have been clearly and understandably informed by the seller or provider about the details specified in the regulation and that they will be obligated to pay if they confirm the order. The right of withdrawal cannot be exercised in service contracts where the provision of the service has begun with the consumer's approval before the expiry of the withdrawal period. The expenses arising from the use of the right of withdrawal belong to the SELLER
6.2 To exercise the right of withdrawal, the BUYER must create a return code from the orders section on the “www.brix.com.tr” website within the 14 (fourteen) day period and deliver the product to the courier company within the 7-day validity period of the return code. The BUYER has the right to choose the courier company to send the product from the options provided by the SELLER. Additionally, the BUYER can exercise the right of withdrawal by sending a written notification via registered mail, fax, or email to the SELLER’s address stated above within the 14 (fourteen) day period. The product must not be used and must be in compliance with the provisions of “Products for which the Right of Withdrawal cannot be Used” under Article 8. In case of using this right,
- The product invoice delivered to the person or BUYER (if the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Return requests for orders with invoices issued on behalf of institutions cannot be completed without issuing a return invoice),

- The products to be returned must be delivered completely and undamaged, including their box, packaging, and standard accessories, if any.
6.3 The SELLER is obliged to return the total amount to the BUYER within 14 days at the latest from the receipt of the withdrawal notification. The BUYER must return the product to the SELLER within 10 days from the use of the right of withdrawal
6.4 If there is a decrease in the value of the product or the return becomes impossible due to the BUYER’s fault, the BUYER is liable to compensate the SELLER's damages at the rate of their fault.
6.5 If the use of the right of withdrawal results in the cancellation of the campaign limit amount set by the SELLER, the discount amount benefited from within the campaign will be canceled.
6.6 In cases where the BUYER uses the right of withdrawal or the product subject to the order cannot be supplied for various reasons, or in cases where the arbitration committee decides to return the product price to the BUYER, the return procedure for shopping made with a credit card is as follows:
6.7 If the BUYER purchased the product in installments, the Bank refunds the BUYER in installments. After the SELLER has paid the full amount of the product to the bank in one go, the installment amounts paid by the BUYER up to the date of the sale cancellation will be returned to the BUYER each month, as an installment, provided that the return dates do not coincide with the account cut-off dates of the credit card, and the BUYER will receive the installment payments made before the cancellation of the sale after the installments of the sale have ended and will be deducted from the existing debts accordingly.
7. COMPLAINTS AND COMPETENT COURT
7.1 You can contact the SELLER through the phone number or e-mail address listed below for any notifications and complaints regarding the contract specified in this Pre-Information Form.
7.2 Complaints and objections arising from the contract specified in this Pre-Information Form will be submitted to the consumer arbitration committee or consumer court where the consumer resides or where the consumer transaction is made within the monetary limits specified in the law below.
7.3 As of 01/01/2017, for claims:
a) Under 2,400 (two thousand four hundred) Turkish Liras to the district consumer arbitration committees,
b) Between 2,400 (two thousand four hundred) and 3,610 (three thousand six hundred ten) Turkish Liras in provinces with metropolitan status to the provincial consumer arbitration committees,
c) Under 3,610 (three thousand six hundred ten) Turkish Liras in the centers of provinces without metropolitan status to the provincial consumer arbitration committees,
d) Between 2,400 (two thousand four hundred) and 3,610 (three thousand six hundred ten) Turkish Liras in districts connected to provinces without metropolitan status to the provincial consumer arbitration committees,
e) Over 3,610 (three thousand six hundred ten) Turkish Liras to the consumer courts.
8. GENERAL PROVISIONS
8.1 The BUYER accepts, declares, and undertakes that they have read, understood, and confirmed the preliminary information about the basic characteristics of the service subject to the contract, the price, and payment method, and the delivery on the SELLER’s website in the electronic environment.
8.2 The BUYER accepts, declares, and undertakes that they have obtained the address to be given to the BUYER by the SELLER before the establishment of the distance sales contract, the basic features of the service requested, the price of the service including taxes, and payment information accurately and completely, and that they have confirmed the Preliminary Information electronically.
8.3 The BUYER accepts, declares, and undertakes that they have the right of withdrawal within the scope of Article 8 of the Distance Contracts Regulation and that they have been informed about this.
8.4 The BUYER accepts and declares that this Pre-Information Form is an integral part of the Agreement.
